We demand the 2024 Arizona Fifty-Sixth Republican Majority Legislature use the plenary authority provided to them in the U.S. Constitution Article 2, Section 1, Clause 2 over the manner of the President of The United States election to provide the voters of Arizona a free and fair election for the President of The United States in 2024 with thefollowing terms:

One election day only (per Arizona Constitution, Article 7, Section 11)

Voting by precinct
-
Requiring proof of U.S. citizenship voter ID
-
Tamper resistant paper ballots
-
Hand count and reporting in each precinct with verified signatures
-
No mail-in voting (allowing absentee ballots under mitigating circumstances with appropriate validation)
-
No machines (tabulators)
-
No internet connections
-
Clean and updated voter rolls
-
Chain of custody verified and complete prior to certification of the election
DETAILS:
The U.S. Constitution’s Article 2, Section 1 authority is plenary and is under the legislative federal function and says the state legislature determines the time (Election Day), manner (in person), and place (Precincts) for the POTUS
election. This power is undeniable and the state legislature's authority to
control the manner of the POTUS election even by directly appointing the
electors has been upheld by SCOTUS numerous times since 1892.
[McPherson v Blacker (1892), Hawke v Smith (1920), Bush v Gore (2000),
Chiafolo v Washington (2020), and most recently Moore v Harper (2023) even
stated that, “in choosing Presidential electors, the Clause “leaves it to the
legislature exclusively to define the method of affecting the object””.]
The state legislature's true plenary authority is only for the POTUS election
(Art 2, Sec 1), not the “down ballot” election (Art 1, Sec 4). This Resolution to
change the manner of the POTUS election can also be voted on with a joint
ballot which would allow us to lose one Republican and still pass it. The
Resolution does NOT require the Governor’s signature!
ALTERNATIVELY: The state legislature can simply pass a +1 majority
Resolution to change the manner of the POTUS election and run a parallel
election to the “down ballot” election.
This will not only show discrepancies in how both elections are run but will
protect the down ballot election from illegalities we have witnessed in 2020
and 2022. Fontes and Richer will be unaware of what the results are for the
POTUS election in real time so they will find it difficult to explain altered results down ballot. For example, if a POTUS Republican wins by 200,000 in
Maricopa it will be very hard to explain how the state legislature turned Blue.
The manner of POTUS election that could be run “parallel” with the “down
ballot” election will be determined solely by the state legislature. If you want
to vote for President and Vice President then you will vote in person, on
Election Day, with a valid ID, in your Precinct. There will NO machines. There
will be no mail-in ballots for the POTUS election, but absentee ballots will be
allowed with verification. All votes for the POTUS election will be hand
counted when the polls close in the Precinct by bipartisan groups. The ballots will not leave the Precinct till the votes are tallied and known publicly before they are transported for tabulation to Maricopa County.
The “down ballot” election will be run like it has been the last two elections
(maladministered) by the AZ Secretary of State, Maricopa County Recorder,
and the Maricopa Board of Supervisors (Election Day responsibilities) with mail-in ballots, drop boxes, machines etc. If a person wants to vote only
on Election Day and does not want to mail a ballot in, they will simply be given a POTUS ballot and a “down ballot” ballot in their precinct. The POTUS ballot will be put in a separate box to be hand counted when the polls close and the other “down ballot” ballot will be put through a machine or door 3 to
be adjudicated. Of course, this is not written in stone and any of the above
can be adjusted but this is what is strongly suggested to our Legislators.
